AMF complaint (mortgage broker)

Any consumer can file a complaint with the Autorité des marchés financiers (AMF) against a mortgage broker or financial institution licensed in Quebec. The AMF investigates conduct breaches.

Definition

The AMF is the financial markets regulator in Quebec, including mortgage brokers (mutual fund dealers, insurance brokers and mortgage brokers). Any consumer can file a complaint free of charge.

Common complaint grounds: - Broker who signed an exclusive mandate without clearly explaining it - Fees not disclosed before signing - False information about loan conditions - Undisclosed conflict of interest (broker submitting to a lender paying undisclosed commissions) - Poor management of confidential client documents

Procedure: 1. Try to resolve the issue directly with the broker or their firm 2. If unsuccessful, file a complaint with the AMF (online form or by mail) 3. The AMF can investigate, impose conditions, suspend or revoke a license 4. The AMF can also issue repayment orders in certain cases
