Definition

The Seller's Declaration is an OACIQ (Quebec Real Estate Brokerage Self-Regulatory Organization) standardized form mandatory in any transaction involving a member real estate broker. It requires the seller to disclose:

- History of major work done (roof, foundations, plumbing, electricity) - Any past disasters (water damage, fire, sewer backup) - Known humidity, mould, or infiltration problems - Presence of known hazardous materials (asbestos, lead, pyrite, radon) - Neighbourhood disputes or conflicts - Rights, easements, or restrictions on the property

Important limitation: the declaration covers only what the seller knows. It does not reveal hidden defects unknown to the seller. Pre-purchase inspection remains essential.

Liability: if the seller lies or deliberately conceals a known defect in the declaration, they may be held liable for damages, even after closing.
